Terms of Service

1. Agreement to Terms

By accessing or using Booker ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, whether as a professional offering services ("Professional") or as a client booking appointments ("Client").

2. Description of Service

Booker is a scheduling and appointment management platform designed for service professionals including therapists, coaches, consultants, tutors, personal trainers, and similar practitioners. The Service enables:

  • Creation and management of appointments and scheduling
  • Client booking through personalised booking pages
  • Automated email and SMS appointment reminders
  • Payment processing and split payment functionality for group bookings
  • Calendar synchronisation with third-party calendar services
  • Recurring appointment scheduling

3. Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorised access or security breach

You must be at least 18 years old to create an account and use the Service.

4. Professional Responsibilities

If you use the Service as a Professional, you acknowledge and agree that:

  • You are solely responsible for the services you provide to your clients
  • You hold all necessary licences, certifications, and insurance required for your profession
  • You will comply with all applicable laws and regulations in your jurisdiction
  • You will maintain appropriate professional standards and ethics
  • You are responsible for setting accurate availability, pricing, and service descriptions
  • You will honour confirmed bookings or provide reasonable notice of cancellation
  • You will handle client data in accordance with applicable data protection laws

Booker is not responsible for verifying Professional credentials or the quality of services provided.

5. Client Responsibilities

If you use the Service as a Client, you acknowledge and agree that:

  • You will provide accurate contact information when booking appointments
  • You will attend scheduled appointments or provide reasonable notice of cancellation
  • You will make payments as agreed when booking paid services
  • You understand that disputes about services should be resolved directly with the Professional

6. Payments and Fees

6.1 Subscription Fees

Professionals may access the Service through paid subscription plans. Subscription fees are billed monthly in advance. All fees are quoted in British Pounds (GBP) unless otherwise stated.

6.2 Payment Processing

Payment processing for appointment fees is provided through Stripe. By using the payment features, you also agree to Stripe's terms of service. Standard payment processing fees apply as set by Stripe.

6.3 Split Payments

For group bookings, the Service offers split payment functionality where each participant pays their share. Professionals are responsible for ensuring accurate pricing and participant information.

6.4 Refunds

Refunds for appointment fees are handled between the Professional and Client. Booker does not process refunds on behalf of Professionals. Subscription fee refunds may be considered on a case-by-case basis at our discretion.

6.5 Price Changes

We reserve the right to modify our subscription pricing at any time. If we increase your subscription price, we will provide at least 30 days' advance notice via email. Price changes will take effect at the start of your next billing cycle after the notice period.

If you do not agree to a price increase, you may cancel your subscription before the new pricing takes effect, and you will not be charged the new rate.

7. Cancellation Policy

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • Your subscription will remain active until the end of the current billing period
  • You will retain access to your data for 30 days after cancellation
  • After 30 days, your data may be permanently deleted
  • Outstanding appointments and client data should be exported before account closure

8. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Send spam, unsolicited communications, or fraudulent content
  • Distribute malware, viruses, or harmful code
  • Attempt to gain unauthorised access to our systems or other users' accounts
  • Interfere with the proper functioning of the Service
  • Scrape, data mine, or collect user information without consent
  • Impersonate another person or entity
  • Engage in any activity that could harm minors
  • Offer illegal services or engage in fraudulent business practices

9. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Booker and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you submit, post, or display through the Service. By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display such content solely for the purpose of operating and providing the Service.

10. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Professionals using the Service to manage client data act as data controllers and are responsible for their own compliance with applicable data protection laws.

11. Third-Party Services

The Service may integrate with third-party services including:

  • Stripe for payment processing
  • Google Calendar and Apple Calendar for calendar synchronisation
  • Email and SMS service providers for notifications

Your use of these integrations is subject to the respective third parties' terms and privacy policies. We are not responsible for the practices of third-party services.

12. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

  • Implied warranties of merchantability and fitness for a particular purpose
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy or reliability of any information obtained through the Service

13. Limitation of Liability

To the maximum extent permitted by law, Booker shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Service
  • Any unauthorised access to or use of our servers or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any disputes between Professionals and Clients
  • The quality or outcome of services provided by Professionals

In no event shall our total liability exceed the amount you paid us in the twelve months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Booker and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

15. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

Your continued use of the Service after any changes constitutes acceptance of the new Terms. If you do not agree to the new terms, please stop using the Service.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
